I. Introduction of the Story
On October, 2025, a Massachusetts company in USA called V Company (for client’s privacy, the company name is abbreviated) found us LegalFly IP, urgently required us to help it register its logo as Chinese trademark, the sooner the better.
Although we have our own daily work schedule, we still quickly responded to the client, and started the progress, because we know, solving client’s urgent need is our mission, and we must help our client.
II. Client’s Desire and the Importance of Registering Chinese Trademark
The first work we did for the client is to understand its particular desire, and why it needed to register Chinese trademark.
After the communication and desire determination, we knew, the client’s products are produced and manufactured in a Chinese factory, and then, the client imports the products from China to USA, where the products are to be sold.
Thus, it was very clear, the client registered Chinese trademark for two reasons:
l The Right of OEM
Usually, if a foreign brand’s products are produced and manufactured in Chinese factory, the factory always requires the brand company to provide the brand right; in China, it is the certificate of Chinese trademark, so as to prove it is the true and real owner of the brand; otherwise, the factory may not be willing to start the process of production and manufacture, because it is at risk that the process of production and manufacture may be required to be stopped by the true and real owner of the brand.
l Products’ Passing Chinese Customs
When the products are well produced and manufactured, and in the process of passing Chinese Customs, Chinese Customs may initially require the brand to provide certificate of Chinese trademark, so as to prove it is the true and real owner of the brand. Meanwhile, Chinese Customs may do the work under the requirement of the others.
No matter in which circumstance, if brand cannot provide certificate of Chinese trademark, the goods may be detained by Chinese Customs, which will definitely cause great loss for the brand.
III. Choice of Class and Items
We asked the client what are their products produced and manufactured in Chinese factory, it told us the products are mainly mat, carpet, rug, etc.
Based on the information, we quickly determined the trademark should be registered in Class 27, and the items should be related to mat, carpet, and rug, and we chose 10 items for the client.
IV. Our Workflow Sequence of Registering Chinese Trademark
l Preparation of Legal Existence and Power of Attorney
We quickly asked the client to provide its document of Legal Existence in Massachusetts, and we asked our long-term cooperative translation company to translate it into Chinese, it took 2 days to complete the translation.
After the completion of translation, we made Chinese Power of Attorney based on the Chinese version of document of Legal Existence. It took 1 day.
l Client’s Seal and Signature
We sent the Chinese version Legal Existence and Power of Attorney to the client, asked it to seal and sign, it took 1 day.
l Submission of Application to China Trademark Office
After we have received the sealed and signed Chinese version Legal Existence and Power of Attorney, we formally started the process of submission to China Trademark Office.
The process is very complex, and because it is our work for the client, so it will not be described here in details.
It took 1 day to complete the submission of application.
l Receipt of Acceptance Notice
After 1 month of our submission of application, which was on November, 2025, we received Acceptance Notice from China Trademark Office, which means the application has passed the form examination, and has entered substantive examination.
l Enter Announcement Period
After 3 months of the receipt of Acceptance Notice, which was on February, 2025, we received notice from China Trademark Office, that the trademark application has been approved, and thus it automatically entered the 3-month Announcement Period.
V. Successfully Registered Chinese Trademark
After the end of the 3-month Announcement Period, which was on May, 2026, we received notice from China Trademark Office, that the logo has been successfully registered as Chinese trademark.
After 1 month of the successful registration, which was on June, 2026, we received Chinese Trademark Certificate from China Trademark Office, and we immediately sent it to the client.
Therefore, a Chinese trademark has been successfully registered, and the trademark right period is 10 years from the date of successful registration.
VI. Conclusion
