I. Introduction

Recently, a Middle East company whose business is auto spare parts contacted us, it would like to register its brand name and logo as Chinese trademark. We immediately started its project after we get contact.

As our usual work, we asked the reason it would like to register Chinese trademark, and it replied that, they produced and imported over 2,000 kinds of auto spare parts in and from China each year, so they want to protect their brand in China. Therefore, we have known its desires, which are brand protection, OEM, and convenient Chinese Customs clearance.

We have checked the statistics issued by Chinese Customs, that the export amount of auto spare parts in 2025 hit USD95.1 billion, which indicates China is a great factory for producing and manufacturing auto spare parts.

II. Class and Items Choice for Clothes

It is easy for us to determine that the core trademark class for auto spare parts is Class 12, and then, we need to determine the items in Class 12.

We asked the company what products they care most, it told us that, considering the wide and huge range of their products, actually it does not have particular products care most, and it asked us to decide items according to our experience.

Our primary consideration is, since the company has wide and huge range of products, so we should try our best to expand the protection range in Class 12.

Each Chinese trademark has at least 10 items. Coincidentally, there are 10 subclasses in Class 12, which means, if we choose 1 item in 1 subclass, and 10 items in 10 subclasses, then the entire Class 12 can be protected. That is because, 1 item in 1 subclass, then the entire subclass can be protected.

Finally, we choose 10 items in 10 subclasses, and they are: locomotive, axle, electric transportation vehicles, cable car, cart, sleigh (vehicle for transport), car tire, aerial transport vehicles, ship, chassis of transport vehicle.

III. Documents Preparation

After the determination of class and items, we well prepared 3 documents for its seal and signature, and they are: original business license, Chinese version business license, Power of Attorney.

After it has sealed and signed all the 3 documents, we submitted the application to China Trademark Office.

IV. Subsequent Procedures

The application will go through subsequent procedures, they are: (1) form examination for 1 month; (2) substantive examination for 3-5 months; (3) Announcement Period for 3 months (if approved); (4) obtaining Chinese Trademark Certificate for 1 month.

Overall, it takes 4-6 months to know the result, and 8-10 months to get the registration certificate.
