I. What is Chinese Trademark Renewal?

Each registered Chinese trademark has its validity period, which is 10 years, such as from June 29, 2026 to June 28, 2036.

Therefore, the trademark needs to be renewed when it is near the expiry date, or the trademark will be cancelled by China Trademark Office, and the owner’s trademark right in China will thus be eliminated.

II. Trademark Renewal Period & Trademark Grace Period

l Trademark Renewal Period

During the 12 months before the expiry date is the Renewal Period, which is the normal period China Trademark Office offers to trademark owner to renew the trademark.

l Trademark Grace Period

During the 6 months after the expiry date is the Grace Period, which is the last remedy period and chance for trademark owner to renew the trademark.

If the owner still does not apply for trademark renewal during this Grace Period, then the trademark will be cancelled by China Trademark Office when this Grace Period ends.

III. Fees for Trademark Renewal

l Trademark Renewal Period

During this period, government fee for trademark renewal is CNY450 per trademark.

l Trademark Grace Period

During this period, except the government fee for trademark renewal, additional surcharge is required, which is CNY225 per trademark; therefore, the total government fee is CNY450+225=CNY675.

l Fees Charged by Trademark Agent

Trademark agent will also charge service fees for providing such trademark renewal service, which may include translation fee, service fee, etc.

IV. Documents Required

The trademark owner shall provide following documents:

l Identity Documents. For company, it is the Business License/Certificate of Incorporation; for natural person, it is the passport.

l Power of Attorney. We will prepare the Power of Attorney for company’s seal and natural person’s signature.

l Original Trademark Certificate. This is not compulsorily required, but the Trademark Number must be provided, so as to determine which trademark is to be renewed.

V. Time Required.

Usually, trademark renewal can be completed with 1-3 months, and China Trademark Office only implement form examination, instead of substantive examination, and the success rate is very high, usually 100%.

VI. Other Questions About Trademark Renewal

1. Will China Trademark Office issue new Trademark Certificate?

No, China Trademark Office does not issue new Trademark Certificate when the trademark renewal has been completed.

It only issues Certificate of Renewal, which should be used together with the old Trademark Certificate.

2. Is there any remedy when the Grace Period has passed?

When the Grace Period has passed, the registered trademark will be cancelled by China Trademark Office, and the owner’s trademark right in China will thus be eliminated.

However, during 1 year after the cancellation is the Protection Period, which means it is not allowed that anyone else to apply for the same or similar trademark during the period, and thus, the original owner is able to apply for a new trademark for it during this 1-year Protection Period.

However, in this case, it is a new application for registration, instead of renewal, thus the application may be rejected under examination, since there may be great changes of Chinese society and Chinese Trademark Laws during the past 10 years, and the success rate needs to be estimated again.

3. Is there any times limit for Chinese trademark renewal?

No, there is no times limit for Chinese trademark renewal.

The trademark owner can apply for trademark renewal per 10 years when it is near the expiry date, and there is no times limit for it, which means, as long as the trademark owner keeps applying for trademark renewal per 10 years, the trademark can be valid forever.
