I. Introduction

Recently, a New Zealand milk powder company entrusted us to register its trademark in China, the main products of the company are adults’ milk powder and infant formula.

According to the company’s description, it is going to enter Chinese market, and is making all the preparations, so it needs to register its trademark in China.

We checked the statistics of Chinese Customs, in 2025, China imported 850,000 tons of milk powder, and the amount is USD7.2 billion. Indeed, China is a huge market for milk powder products because of the 1.4 billion consumers.

II. Class and Items Choice for Milk Powder

Ordinary milk powder and adults’ milk powder shall be registered in Class 29, and infant formula shall be registered in Class 5.

We chose 10 items in Class 29, and they are: milk powder, milk, condensed milk, yogurt, cheese, cream (dairy), milk-based beverages, butter, whey, dairy products.

We chose 10 items in Class 5, and they are: infant formula, powdered milk for babies, food for babies, lacteal flour for babies, dietetic food adapted for medical use, dietetic beverages adapted for medical use, mineral dietary supplements, nutritional supplements, dietetic substances adapted for medical use, albumin dietary supplements.

The items we chose covers the client’s products, and the client is satisfied with the items we selected for it.

III. Documents Preparation

After the determination of class and items, we well prepared 3 documents for its seal and signature, and they are: original business license, Chinese version business license, Power of Attorney.

After it has sealed and signed all the 3 documents, we submitted the application to China Trademark Office.

IV. Subsequent Procedures

The application will go through subsequent procedures, they are: (1) form examination for 1 month; (2) substantive examination for 3-5 months; (3) Announcement Period for 3 months (if approved); (4) obtaining Chinese Trademark Certificate for 1 month.

Overall, it takes 4-6 months to know the result, and 8-10 months to get the registration certificate.
